Welcome to Migs and Mart Grocery (“we,” “us,” or “our”). By accessing our website or placing an order through our platform, you agree to these Terms of Service. Please read them carefully before ordering.
1.1 Our grocery delivery service is strictly limited to locations within a 10-kilometer radius of Zamboanga City, Philippines.
1.2 Anyone may place an order on our platform regardless of physical location; however, order fulfillment and delivery are only available within Zamboanga City, Philippines, subject to serviceability.
1.3 Orders with delivery addresses outside our service area may be cancelled or declined without any prior notice or notification from us.
• Orders placed before 12:00 PM will be fulfilled on the same day starting from 5:00 PM onwards.
• Orders placed from 12:01 PM onwards will be fulfilled the next day starting from 10:00 AM onwards.
• Orders placed before 4:00 PM will be fulfilled within 3 hours, counted from the time:
✓ the order is confirmed, and
✓ partial or full payment is successfully received.
• Orders placed from 4:01 PM onwards will be fulfilled on the next day starting from 9:00 AM onwards.
2.3 Delivery timelines are estimates and may be affected by traffic, weather conditions, order volume, holidays or other circumstances beyond our reasonable control.
2.4 Hence, these delivery timelines are not guarantees.
3.1 We reserve the right to cancel or remove specific items from an order due to:
• product unavailability,
• supplier constraints,
• quality or safety concerns.
3.2 We may also cancel an order entirely due to reasonable logistical or delivery-related issues, including but not limited to:
• incorrect, incomplete, or unreachable delivery addresses,
• unsafe or inaccessible delivery locations,
• road closures, weather disturbances, or natural disasters,
• courier, manpower, or vehicle unavailability,
• force majeure or other events beyond our control.
3.3 Any applicable payments will be refunded or adjusted accordingly within 1-3 business days up to 60 days, depending on the payment method used by the customer.
4.1 All Cash-on-Delivery orders require a ₱500 downpayment prior to order confirmation.
4.2 Orders will only be processed after the required downpayment has been successfully received.
5.1 Compliance with the Data Privacy Act
Migs and Mart Grocery complies with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules and regulations.
5.2 Information We Collect
For order processing, delivery, and customer communication, we may collect the following personal data:
• Full name
• Email address
• Phone number
5.3 Purpose of Collection
Personal information is collected and processed for legitimate business purposes, including:
• order fulfillment and delivery coordination,
• customer support and service-related communications,
• account management and transaction records,
•marketing and promotional communications
5.4 Consent
By placing an order and providing your personal information, you consent to the collection, use, storage and processing of your data in accordance with this Terms of Service and applicable Philippine data privacy laws.
5.5 Data Protection & Retention
We implement reasonable organizational, technical, and physical security measures to protect personal data against unauthorized access, disclosure, loss or misuse. Personal data is retained only for as long as necessary to fulfill its stated purpose or as required by law.
6.1 Customers may receive marketing or promotional messages related to our products or services.
6.2 You may withdraw your consent and opt out of marketing communications at any time by contacting us at migsandmartgrocery@gmail.com
6.3 Opting out of marketing communications does not affect transactional or service-related messages necessary for order fulfillment.
7.1 We reserve the right to modify or update these Terms of Service at any time.
7.2 Continued use of our platform after changes are posted constitutes acceptance of the updated terms.
